Paul Adom-Otchere, the former Board Chairman of the Ghana Airports Company Limited (GACL), has initiated a legal challenge against the Office of the Special Prosecutor (OSP), filing a motion at the High Court in Accra to strike down a directive ordering him to declare his assets and income.
The application, lodged by his legal team led by the former Attorney-General, Godfred Dame, contends that the OSP’s action is “manifestly unlawful” and an “abuse of power.”
The legal action stems from a “Notice to Declare Property and Income” dated 4th August 2025, which was served on Adom-Otchere by the OSP.
He is currently under investigation by the anti-graft body concerning the award of a revenue assurance contract by GACL to Evatex Limited. In his application for judicial review, Adom-Otchere is seeking specific reliefs from the court.
Firstly, he requests “a declaration that the directive of the Special Prosecutor for the applicant herein to declare his property and income… is manifestly unlawful, in violation of the Office of the Special Prosecutor Act, 2017 (Act 959) and Office of the Special Prosecutor (Operations) Regulations, 2018 (L. I. 2374), and amounts to an abuse of power of the Special Prosecutor.” He further asks the court for “an order of certiorari to bring in the directive of the Special Prosecutor complained of… and quash same as being in violation of due process.”
Beyond the declaration order itself, the application also challenges the conduct of the OSP. A
dom-Otchere seeks a declaration that threats issued by the OSP of “legal consequences”, “confiscation of property or income” and “detention” following the service of the notice are “an unlawful harassment of the applicant and in violation of the applicant’s fundamental human rights.”
Additionally, he is asking the court for an order to prohibit the OSP from detaining him should he refuse to comply with the declaration directive.
